We recognizie abuse and neglect in a nursing home is difficult because the elderly resident is often incapable of communicating the nature and occurrence of the abuse due to physical or mental infirmities.
Because of the difficulty in recognizing abuse, you should never take the resident's care for granted. The nursing home resident's only protection may be the family's diligence in reporting any suspected abuse or neglect.

As the elderly population of Florida increases, so have incidents of neglect and abuse in nursing homes. Because elderly people have to rely on others for care, they are necessarily more subject to the risks of abuse and neglect. The abuse or neglect can be recurrent or a single egregious event which produces injury, either physical or financial.
There are several common types of injuries that are seen as a result of progressive abuse. These include bedsores, severe dehydration or malnutrition, septic shock, gangrene and aspirational pneumonia. Other areas of concern are over-medication or under-medication, failure to adequately supervise and to prevent injury to the resident, mental abuse and even theft of personal items.
As with all other areas of law handled by Piccin & Glynn, you do not pay any attorney's fees or costs until we reach a full and fair settlement or a final judgment against the insurance company.
